In Ontario, when an employee is dismissed without cause, their employer is required to give that employee advance notice of their dismissal, or pay-in-lieu of notice. A “wrongful dismissal” occurs when an employer does not provide an employee with the proper amount of advance notice, or pay in lieu of notice, that is required by law.
